Terms of Service
Last updated August 22, 2026
These Terms of Service (“Terms”) govern your access to and use of the Five Point Social website (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
Five Point Social provides information about social media marketing, content creation, account management, and related creative services for cannabis businesses. The Site is intended to introduce our services and allow prospective clients to contact us.
Content on the Site is provided for general informational purposes. It is not a binding offer, and submitting an inquiry does not create a client, agency, fiduciary, or other professional relationship. Any paid services will be governed by a separate written proposal, statement of work, or client agreement. If that agreement conflicts with these Terms, the client agreement controls for those services.
2. Eligibility and acceptable use
You may use the Site only for lawful purposes. If you submit information on behalf of a business, you represent that you are authorized to do so.
You may not:
- interfere with the Site’s operation or security;
- attempt to gain unauthorized access to the Site or its supporting systems;
- submit malicious code, false information, or content that violates another person’s rights; or
- use the Site in violation of applicable law or regulation.
3. Information you submit
You are responsible for ensuring that information submitted through the Site is accurate and that you have the right to provide it. You authorize us to use submitted information to respond to your inquiry, evaluate a potential engagement, and communicate with you about our services, as described in our Privacy Policy.
Do not submit sensitive personal information, payment-card information, passwords, patient information, or regulated health information through the contact form.
4. Intellectual property
Unless otherwise stated, the Site and its text, graphics, branding, videos, designs, and other content are owned by or licensed to Five Point Social and are protected by applicable intellectual-property laws. You may view the Site for your own personal or internal business use. You may not reproduce, distribute, modify, sell, or exploit Site content without prior written permission.
Ownership and permitted use of work created for a client will be addressed in the applicable client agreement.
5. Third-party services and links
The Site may link to or rely on third-party services, including Instagram, Meta platforms, and Netlify. Those services are operated independently and may be governed by their own terms and privacy practices. We are not responsible for third-party content, availability, policies, moderation decisions, account actions, or security.
6. Cannabis-industry compliance
Cannabis laws, advertising restrictions, and platform rules vary by location and change over time. You remain responsible for confirming that your business, products, claims, promotions, and content comply with applicable laws, regulations, licenses, and platform policies. Five Point Social does not provide legal advice, and you should consult qualified counsel when needed.
7. No guaranteed performance
Marketing outcomes are inherently uncertain. Five Point Social does not guarantee any specific number of followers, impressions, engagements, leads, conversions, sales, revenue, account approvals, account availability, advertising costs, or other result.
Any projections, ranges, examples, testimonials, or prior results shown on the Site are illustrative or anecdotal. They are not promises of future performance. Results vary based on factors outside our control, including the client’s business, market, content, audience, budget, competition, platform algorithms, enforcement decisions, and changes in law or policy. See our Disclaimer for additional information.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We disclaim all express and implied warranties relating to the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free availability.
9. Limitation of liability
To the fullest extent permitted by law, Five Point Social and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Site.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
10. Changes to the Site or these Terms
We may update the Site and these Terms from time to time. Changes take effect when posted, with the “Last updated” date revised above. Your continued use of the Site after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles, except where applicable law requires otherwise.
12. Contact
